Litigation Update: J&J Talc Recall

Late last month Johnson & Johnson announced a voluntary recall of approximately 33,000 bottles of its baby powder after the FDA reported finding chrysotile asbestos in the product.

While J&J maintains that “thousands of tests over the past 40 years repeatedly confirm that our consumer talc products do not contain asbestos”, it appears that the bottle of baby powder tested by the FDA did in fact contain traces of asbestos. This raises serious questions about the testing methodologies employed by J&J over the years.

J&J talc products are at the center of thousands of claims by people who developed ovarian cancer or mesothelioma that they attribute to their use of these products. In addition, earlier this year J&J disclosed they were being investigated by the Department of Justice and the Securities and Exchange Commission over concerns about possible asbestos contamination of their talc products.

Bausch Health, who acquired the rights to Shower to Shower from J&J in 2012, recently disclosed that they have reformulated that product to replace the talc with cornstarch, although they deny it is due to any safety concerns.
